Terms and Conditions of Use and Personal Data Protection
Membership within this platform involves the provision of personal data; we inform you that your personal data will not be disclosed to third parties.
Data Controller: The “Drumeții Montane" Association, with its registered office in Bucharest Municipality, Bucharest County, Romania, Tax Identification Number (CUI): 27700553, Contact email: [email protected], legally represented as the controller of personal data, in accordance with Regulation (EU) 679/2016 (GDPR).
1. Purpose of the Document
1.1. This document establishes the terms and conditions for the use of the mantrailing.ro platform, as well as the rules regarding the processing of users' personal data (members, volunteers, project participants, partners, etc.).
1.2. The recorded information is intended for use by the “Drumeții Montane" Association and is communicated only to the following recipients: the data subjects and the contractual partners of the controller.
1.3. At the same time, you have the right to object to the processing of your personal data and to request the deletion of such data. You agree that the deletion of your personal data will be followed by the deletion of your account from the system and by the impossibility to benefit from or participate in our projects.
1.4. In order to exercise these rights, you may submit a written request stating your requirement, which should then be sent by e-mail to the address [email protected].
1.5. If any of your data is inaccurate, please inform us as soon as possible.
2. Definitions
2.1. User - any natural or legal person who accesses or uses the Platform.
2.2. Volunteer - any natural or legal person who accesses or uses the Platform.
2.3. Registered User - a user who has created an account.
2.4. Content - any text, image, video, file, event, article, or information published on the Platform.
2.5. Site - the mantrailing.ro platform
3. Account Creation and Use
3.1. In order to access certain functionalities, the creation of an account is required.
3.2. Upon registration, the User undertakes to provide accurate, complete, and up-to-date information.
3.3. The User is responsible for maintaining the confidentiality of access credentials (email and password).
3.4. The User is responsible for all activities carried out through their account.
3.5. The Platform reserves the right to suspend or terminate accounts that violate these Terms or the applicable legislation.
4. Role of the Platform
4.1. mantrailing.ro is a platform for intermediation and content publication and is not the direct organizer of the promoted events (except where explicitly stated).
4.2. The Administrator:
4.2.1. does not guarantee the accuracy of the information published by users;
4.2.2. is not a party to the relationships between users;
4.2.3. is not responsible for the actual conduct of events promoted by third parties.
5. Users' Rights and Obligations
5.1. All information you have provided during the registration process must be true, complete, and accurate. Furthermore, you undertake to notify the Site of any changes that may occur regarding the data you have provided during the registration process. You understand that such notification must be made within a maximum of 10 days from the date on which the changes occurred. If the information provided by you is not true, accurate, or complete, the Site reserves the right to suspend your right to use, in whole or in part, the projects or to access the site.
5.2. The Site is a portal where registered members have the possibility to participate in various activities and to publish events, association presentations, and articles. As a user, you are entirely responsible for all materials that you upload to the site, send by email, or publish. By submitting such material, regardless of its type - text, images, video/audio files - you agree to the following limitations:
5.2.1. you may not publish, transmit, or make reference, in any manner whatsoever, to messages containing illegal, threatening, abusive, indecent, or violent content;
5.2.2. you may not collect the personal data of other users of the Site, nor may you restrict the access of other users to different areas or types of content within the Site;
5.2.3. you may not use any programs, automated devices, or any manual procedures to monitor or copy the pages of the Site or their content without prior written authorization from the representatives of the Site;
5.2.4. you may not publish material with pornographic, erotic, racist, xenophobic, antisemitic content or any other type of material that encourages hatred against a certain human, professional, or other category;
5.2.5. you may not publish material that violates or circumvents, in any way, the legal regulations in force, including but not limited to copyright law, the rights granted to inventors, trademark holders, and any other rights protected by intellectual and industrial property law, the right to privacy of individuals, rights arising from a contract, or other rights held by third parties;
5.2.6. you may not publish material that promotes, refers to, or uses software or promotional options of a nature that send unsolicited e-mails;
5.2.7. you may not publish material that violates any provisions of national or European Union legislation or international regulatory norms;
5.2.8. you may not publish material of a threatening, abusive, harassing, defamatory, slanderous, insulting, obscene, profane, indecent nature, or material that is subject to public opprobrium;
5.2.9. you may not use any device, including software devices or subroutines, that interferes or attempts to interfere with the proper functioning of the Site or with the normal operation of the promotion options;
5.2.10. you shall not carry out any action that imposes any unusual, unreasonable, abusive, or disproportionate use of the infrastructure made available by us through the site;
5.2.11. you shall not copy, reproduce, alter, modify, distribute (including by public display), use for commercial purposes or for any other purposes the content of the site (or any part thereof), and you agree not to create works / web pages / online promotional options that reproduce in any way sections of the Site, without prior written authorization from the Site and/or the relevant third party, as applicable;
5.3. By completing certain online forms in a manner that does not comply with the limitations mentioned above, you agree that you are solely responsible and shall fully indemnify the Site in the event of any damage.
5.4. You shall not copy, sell, redistribute, rent, sublease, or carry out any other action intended to transfer your user account or any other materials provided to you in connection with the activation of the user account to any third party, without the prior express consent of the Site.
5.5. You shall comply with all legal provisions that may supplement the rights and obligations assumed by you through acceptance of the terms of this Agreement.
5.6. In the event of any damages caused by you to the Site or to a third party, you agree to fully pay all damages or compensation due thereto, including any court costs, enforcement costs, and any other related expenses.
6. Information regarding registration on mantrailing.ro
6.1. Upon registration, the Platform may request certain information, such as: email address, first and last name, and data about you or about the institution/company you represent.
6.2. Following registration, access to the account is performed by entering an email address and a password. Users are obliged to carefully safeguard their account access credentials. We recommend that you do not disclose your password to anyone. Representatives of the Drumeții Montane Association will never request your account password via unsolicited messages or phone calls. We therefore advise you not to disclose this password to persons who request it. Furthermore, where possible, you should click the “Log out" button from your account or use other online options provided by the Drumeții Montane Association at the end of each usage session. We also advise you to close the browser window in which you have worked at the end of your browsing session.
6.3. mantrailing.ro shall not be liable for any moral or material damage caused by failure to comply with this provision.
6.4. You agree that you bear responsibility for any material you submit through this platform, including, but not limited to, its legality, reliability, timeliness, originality, copyright, and ownership rights over such materials or content.
7. Content Publication
7.1. Published content may be subject to a moderation process.
7.2. The representatives of the Site may approve or reject the published content / submitted application and may decide to delete it without informing the user.
7.2.1. The fields required for content publication are public fields. Content entered by users through these fields is public and may be accessed, viewed, and distributed by other users or visitors of the platform.
7.2.2. The User is responsible for the information published and ensures that they hold all necessary rights over the content provided.
7.3. The representatives of the Site may delete any content added by a user if they consider that the information is incomplete or may notify subscribers to modify the content in order for it to be approved and published.
7.4. To the extent possible, the user will be informed about the measures taken and may request clarifications or a review of the decision.
8. Intellectual Property Rights
8.1. The User retains the copyright over the published content.
8.2. By publishing, the User grants the Administrator a non-exclusive, royalty-free, territorially unlimited license to display, distribute, and promote the content within the Platform.
8.3. The content of the Platform (structure, design, proprietary texts) is protected by copyright legislation.
9. Personal Data Protection
9.1. mantrailing.ro fully acknowledges the importance of personal data and undertakes to protect their confidentiality and security. It is very important for us and for you to provide all information in a comprehensive manner regarding the processing of your personal data, as detailed within the Terms and Conditions section.
9.2. Certain data may be made public by the user's own will; however, such data may still constitute personal data within the meaning of the GDPR.
9.3. mantrailing.ro respects the confidentiality of all users and visitors and will process personal data with great care, under technical and organizational security conditions appropriate to the applicable legislation.
9.4. Personal data is collected only with your consent or acceptance, provided that such data is offered knowingly, voluntarily, of your own initiative, either at the request of mantrailing.ro, when completing an online form, or when subscribing to a newsletter.
9.5. If you do not agree with the terms presented on this page, please do not use it and do not provide us with your personal data.
10. Personal data processed by mantrailing.ro
10.1. The processing of personal data consists of all sets of operations performed on personal data provided by any means, whether automated or non-automated, such as: registration, authentication, registration date, last authentication date, collection, structuring, storage, adaptation or modification, consultation, use, disclosure by transmission, making available in any other manner, restriction, blocking, or destruction.
10.2. In the context of the current activities carried out by mantrailing.ro through this website, involving registration, publication, or subscription to the newsletter, as well as in the context of fulfilling applicable legal obligations, the Drumeții Montane Association may request certain personal data.
10.3. The Drumeții Montane Association will process, among others, the following categories of personal data: the user's full name, telephone number, locality, and email address.
11. Data subjects whose data may be processed
11.1. Current, former, or potential users who are natural persons or legal entities, visitors, volunteers, representatives, or their authorized persons, whether conventional or legal.
12. Refusal to provide personal data
12.1. As a user, you are required to provide complete, up-to-date, and accurate data in order to participate in various projects/events through this site.
12.2. The Drumeții Montane Association will request the personal data necessary for registration, and refusal to provide personal data may result in the inability to access all sections of the Drumeții Montane Association website.
12.3. When you register or complete an online form on the Drumeții Montane Association website, as well as when you subscribe to a newsletter, personal data will be collected. At the same time, as a visitor, personal data will be collected only if contact and email forms are completed, for the purpose of fulfilling legal obligations and carrying out current activities based on legitimate interest.
12.4. If the processing of personal data is no longer necessary for accessing sections protected by username and password or for fulfilling a legal obligation and is not justified by a legitimate interest of the Drumeții Montane Association, you may refuse such processing of data or withdraw the consent previously given upon registration.
13. Purposes of collecting personal data
13.1. Purposes:

- Registration as a volunteer;
- Partnerships;
- Promotion of events;
- Promotion of the association;
- Publication of videos/photos for the purpose of promoting projects/events;
- Fulfillment of applicable legal obligations;
- Settlement of disputes and litigation, enforcement of court decisions, arbitral awards, and court orders;
- Prevention of the use of the platform for illegal purposes;
- Audit and control activities or supervision;
- Loyalty programs, transmission of general or personalized offers, development and improvement of promotional options;
- Enrollment in various projects.
13.2. The Drumeții Montane Association shall consider all information collected from users as confidential and shall not share it with third parties, except for local and central public authorities, police, prosecutor's offices, judicial authorities (within the limits of legal provisions and/or as a result of expressly formulated requests), judicial enforcement officers, banking institutions, insurance and reinsurance companies, and market research organizations (for statistical purposes).
13.3. The confidentiality of personal data shall be ensured by the Drumeții Montane Association and such data shall not be provided to other third parties beyond those mentioned in this document.
14. Duration of personal data processing
14.1. The Drumeții Montane Association shall process personal data from the date of completion of a form until the moment you exercise your right to erasure, except in cases where you participate in the projects/events of the Drumeții Montane Association. After the completion of personal data processing operations for the purpose for which they were collected, erasure may be limited where there are legal obligations or legitimate interests (e.g. legal defense). The Drumeții Montane Association shall archive personal data for the duration of the Association's internal procedures or such data shall be destroyed.
15. Data storage duration:
- account data: for the duration of the existence of the account + 1 year in backups;
- newsletter data: until unsubscription;
- technical data/logs: maximum 6 months.
16. Security measures used to protect personal data
16.1. The Drumeții Montane Association uses security methods and technologies, together with appropriate policies and working procedures, to protect your personal data in order to prevent unauthorized use thereof.
16.2. The Drumeții Montane Association cannot guarantee the complete security of data transmitted via the internet by the user to the servers of the Drumeții Montane Association (the user may be using an infected device, an infected browser, or an unsecured internet network). Any information transmitted to our servers shall be done at your own risk, and once the information is received, we will apply strict security procedures and measures against unauthorized or unlawful use, destruction, accidental loss, or disclosure of personal data.
17. Promotions, Newsletter, and advertising on the site
17.1. The personal data provided by you (first name, last name, email address, telephone number) may be processed by the Drumeții Montane Association in compliance with your rights, in particular the right to be informed and the right to object, for the purposes mentioned in this document.
17.2. If the Drumeții Montane Association intends to use your personal data for direct marketing purposes (only if you have opted for this), you will be informed in advance.
17.3. If you express your wish for your personal data to cease being processed by the Drumeții Montane Association, you may expressly request the termination of any personal data processing.

18.1. By reading these Terms and Conditions, you have been informed about the rights you benefit from, in accordance with the applicable legal provisions.
18.2. The right to lodge a complaint
18.3. Without prejudice to any other administrative or judicial right or remedy, you have the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP).
19. How can you exercise your rights?
19.1. By exercising these rights, you may contact the Personal Data Specialist within the Drumeții Montane Association by submitting a request sent by email, dated and signed, to the address [email protected].
20. Limitation of Liability
20.1. To the maximum extent permitted by law, the Drumeții Montane Association shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages of any kind arising from the use or inability to use this website.
21. Final Provisions
21.1. These provisions may be subject to occasional amendments/updates.
21.2. By accessing the website or by completing online forms, following any amendments made to these Terms and Conditions, such amendments shall be deemed accepted.
